Northern Dynasty Reports Oral Arguments Held

Northern Dynasty Minerals Ltd. held oral arguments on June 25, 2026, in Alaska Federal District Court regarding its legal challenge to the Environmental Protection Agency's veto of the Pebble Project. The company states that the litigation is now "ripe for decision" by the Federal District Court in Alaska.

The legal action seeks the withdrawal of the EPA's veto and challenges the EPA's Final Determination and the USACE's Record of Decision (USACE ROD) under the Clean Water Act. The Pebble Project comprises a 100% interest in 1,840 contiguous mineral claims in Southwest Alaska, including the Pebble deposit, located 200 miles from Anchorage and 125 miles from Bristol Bay.

The National Environment Policy Act (NEPA) process mandates a comprehensive "alternatives assessment," indicating that final project design, operating parameters, and infrastructure may differ significantly from current plans. The release outlines material risks regarding the securing of federal and state permits, commercial viability, financing requirements, potential third-party opposition, and changes in government policy.
