DPM Metals Announces Constitutional Court of Bosnia and Herzegovina Decision
DPM’s Vareš concession remains valid as the court mandates legal conformity while allowing operations to continue.

The Constitutional Court of Bosnia and Herzegovina ruled that the Vareš Concession Agreement and its annexes were not in conformity with the Constitution, citing that local authorities lacked the legal authority to dispose of state-owned forest land without the involvement of the state Attorney General. However, the Court did not terminate, invalidate, or suspend the Concession Agreement. Operations at the Vareš mine continue normally with no immediate production halt.
The Court granted a six-month remediation window for relevant authorities and the Attorney General to review the acts and bring the matter into legal conformity. DPM Metals intends to engage constructively with the Attorney General and authorities throughout the process. The decision is final and not subject to appeal.
The ruling introduces a regulatory overhang but does not constitute an immediate operational or financial shock. The explicit preservation of the concession and the continuation of operations mitigate near-term downside risk. However, the six-month remediation window creates uncertainty regarding potential royalty adjustments, renegotiation costs, or administrative delays, which could marginally impact AISC or capex timing. Given the company's strong balance sheet and the court's protective stance, this is a manageable jurisdictional risk rather than a terminal event. The market's reaction, with price consolidation between $58 and $63 in September, suggests the news is largely priced in as a routine regulatory hurdle.
